1) Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site. By using the Site, you represent that you meet this requirement.

8) Forms, Requests, and Communications Consent

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANTHEM AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR CONTENT, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANTHEM’S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID TO ANTHEM FOR SITE ACCESS (IF ANY) IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12) Indemnification

You agree to indemnify, defend, and hold harmless Anthem and its affiliates, officers, directors, employees, agents, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Site, violation of these Terms, or infringement of any rights of another.

13) Changes to the Site and Terms

We may modify or discontinue the Site (or any portion) at any time without notice. We may also update these Terms from time to time. The “Last Updated” date will reflect changes. Your continued use of the Site after changes means you accept the updated Terms.

14) Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and share information. Please review it carefully. If you use cookies or tracking technologies, those practices are described in the Privacy Policy and/or a Cookie Notice (if applicable).

15) Governing Law

These Terms are governed by the laws of the State of CA, without regard to conflict of laws principles, except where federal law applies.

 

IMPORTANT: The enforceability and ideal structure of arbitration/class waiver provisions depend on your jurisdiction and operations. Have counsel review before using.

At Anthem’s sole discretion, any dispute arising out of these Terms or the Site may be resolved by binding arbitration administered by merican Arbitration Association (AAA) under its applicable rules. The arbitration will take place in CA, unless the parties agree otherwise.

Class action waiver: To the extent permitted by law, you agree that disputes will be brought only in an individual capacity and not as a plaintiff or class member in any class, collective, consolidated, or representative action.

Small claims: Either party may bring an individual claim in small claims court if it qualifies.

17) California and Other State Consumer Rights (If Applicable)

If you are a California consumer, you may have additional rights under California law. If you operate nationwide, your counsel may add state-specific disclosures as needed.

18) Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

19) Entire Agreement

These Terms (and any policies referenced, including the Privacy Policy) constitute the entire agreement between you and Anthem regarding your use of the Site, superseding any prior agreements relating to the Site.
